How to judge age bias; justices mull two questions of proof in potential landmark

An age discrimination case pending in the US Supreme Court, Reeves v. Sanderson Plumbling Products, is discussed. The circuits disagree on two evidence issues in age discrimination cases, and the courts will rule on these.

The lack of a single overriding theme in the employment discrimination cases to be heard by the US Supreme Court during the 2001-2002 term are discussed. Most are Americans with Disabilities Act cases.

Title VII punitives before justices; arguments on March 1 will deal with what standard is to be used

Article Abstract:

Kolstad v. American Dental Assn, pending before the US Supreme Court, considers whether punitive damages can be used for employment discrimination cases. Before the Civil Rights Act of 1991, successful plaintiffs could obtain only equitable relief, such as reinstatement and back pay. The provision in the act limiting the recovery of punitive damages to cases in which the plaintiff demonstrates that the defendant showed "malice or reckless indifference" to an individual's protected civil rights in discriminating. The plaintiff lost out on a desired job promotion and claimed it was because of her sex.
