UK's environmental watchdog brought to heel

Article Abstract:

The case of Ian Cook vs. Environment Agency and May Gurney Ltd in which environmental agency is prosecuted for breach of duties under environmental legislation, is analyzed in detail. The case has made a beginning of such cases where private prosecution of environmental agencies is conducted, considering the fact that the regulator itself is at fault.

Contaminated land: The impact of two UK landmark cases

Article Abstract:

The two landmark cases, R (formerly Transco Plc) v Environment Agency and Circular Facilities Ltd v Sevenoaks District Council involving contaminated land in the UK are analyzed. An attempt is made to consider how these two cases have impacted the interpretation and application of liability-determining provisions of the contaminated land regime.

Waste recovery: Salvaging some meaning from waste definitions?

Article Abstract:

A very important case on the definition of waste in relation to recovered and recycled materials was heard at the end of 2006 in the UK Administrative Court. Two joined applications for judicial review in Solvent Resource Management Ltd v The Environment Agency & OSS Group Ltd v The Environmental Agency [2006] EWHC 3023 were considered.
