Vocabulary of ADR procedures

Article Abstract:

A vocabulary of alternative dispute resolution techniques should be created so that all ADR participants share the same understanding of the process. A vocabulary would include terms such as classic mediation, evaluative mediation, hybrid mediation, and med-arb. Classic mediation is traditional mediation. Evaluative mediation is the classic approach with early evaluation by the mediator. Hybrid mediation includes a technical expert. Med-arb uses arbitration as a follow-up to mediation.

Article Abstract:

The intent of alternative dispute resolution (ADR) may be misunderstood because the parties involved do not share a common vocabulary for ADR techniques. Confusion may stem from cultural or geographic differences. Parties must share the same understanding of the key terms in ADR and recognized that approaches to disputes may be based on interests, rights and power.

Article Abstract:

A standard Alternative Dispute Resolution (ADR) vocabulary does not exist. Factors such as geographic location and culture create varying definitions. Several terms can be clarified such as mini-trial, neutrality, judicial arbitration, private judging and partnering.
