When parents pay for their children's wrongs: Attribution of liability for EC antitrust infringements in parent-subsidiary scenarios

Article Abstract:

The legal analysis of the elements considered by the European Commission when deciding whether to attribute liability to parent companies for infringements by their subsidiaries, as well as the stance taken on this matter by the Court of First Instance and the European Court of Justice is reported. The Commission should reduce uncertainty, should avoid unnecessary litigation and artificial procedural complexity arising from the fact that undertakings are currently unaware of the effect that their conduct during the procedure may have on decisions regarding liability.

Are sports cartels different? An analysis of EU Commission decisions concerning collective selling agreements for football broadcasting rights

Article Abstract:

The decision by the EU Commission to permit collective selling of broadcast rights for FA Premier League (FAPL) football matches contradicts its earlier stance against such anti-competitive and 'price-fixing' measures. The present arguments favoring the collective selling agreements are analyzed, and are not found to be justified by evidence.
