Consequential damages exclusions under UCITA

Article Abstract:

The author discusses the effect of the Uniform Computer Information Transactions Act on the enforceability of software development contract clauses that exclude consequential damages. A number of state court decisions which appear to be at variance with the provisions of the UCITA are analyzed.

Article Abstract:

Although software publishers' associations tend to support the Uniform Computer Information Transactions Act, many software engineers' groups oppose it. The author examines in detail the reasons for this opposition, noting that the law will harm smaller software developers.
