Community groups lose fight for access to FDIC records; agency can withhold data because opposition may jeopardize project, court rules

Article Abstract:

The US Court of Appeals for the Second Circuit ruled in Nadler v. FDIC that real estate development plans held by the Federal Deposit Insurance Corp. as receiver for a failed bank were exempt from the Freedom of Information Act as proprietary records. US Rep. Jerrold Nadler and community activists opposed to the development argued that the exemption could not apply because the FDIC was not a private interest that could suffer a competitive harm. The Court found that the exemption was intended to cover all financially sensitive information.

Emergency response tapes are not decision-making records

Article Abstract:

The Pennsylvania Supreme Court ruled in North Hills News Record v. Town of McCandless that audio tapes of emergency calls to police and emergency personnel are not "public records" subject to disclosure under the state Right to Know Act. Tapes of emergency calls do not demonstrate the close connection between calls and subsequent agency decision-making to meet the access requirements of state and federal open records laws, the court said.
