Court throws out order opening records

Article Abstract:

The US Court of Appeals for the 1st Circuit has overturned the US District Court in Puerto Rico in a case regarding access to the governor's records. The governor had ordered that access to governmental information be limited and a reporter had sued. A lower court issued a temporary restraining order to prevent the governor enforcing his order and the governor appealed. The Court of Appeals ruled that since the governor had been prevented from enforcing his order no harm had occurred and that application of First Amendment right of access was questionable.

Court guts state's open records law

Article Abstract:

The Florida Supreme Court has ruled that the state's public records law applies only to legislatively-created governmental bodies and not those created by the state's constitution. The plaintiff had argued that legislators are public servants and, therefore, the public should have access to their records. The court, however, disagreed and interpreted the law to exempt Florida's governor, cabinet officers, legislators, and court officials.

States move to open access to records

Article Abstract:

Eighteen states considered legislation and passed laws regarding the opening of government meetings and government records in 1992. A survey of the laws states have passed and considered is presented.
