News organizations wins six-year battle for access to coal tax records

Article Abstract:

A Montana Supreme Court ruling in Associated Press v. Montana Department of Revenue is discussed, and held unconstitutional a departmental ruling limiting access to tax information. A significant privacy concern was cited as the only justification for barring access.

Newspapers are raising challenges to states' open record laws to test governmental compliance. State audits since 1997 reveal that police agencies have the lowest compliance rates.
