Confidentiality agreements and sealed court records frustrate the First Amendment access necessary for a free press. The New York Daily News and the Baltimore Sun had to request appellate courts to release records that had been erroneously sealed.

Overcoming access hurdles to court martial evidence in Iraq prison abuse cases

Article Abstract:

The way to overcome access hurdles legally, and the evidences introduced in the court martial in Iraq prison abuse cases are discussed. Various rules and laws enacted by the Uniform Code of Military Justice in relation to court-martial are explained.

Proposed federal shield laws emerge from leak probes

Article Abstract:

Two measures seeking to create a federal shield law is introduced by the Congress securing reporters across the United States who were threatened with served jail sentences for refusing to reveal confidential sources. The measures, Free Flow of Information Act of 2005 and Free Speech Protection Act of 2004 would create an absolute privilege for disclosure of information about confidential sources and a qualified privilege for disclosure of related newsgathering materials.
