Police promotional exam scores, scale must be disclosed

Article Abstract:

The Iowa Supreme Court ruled in DeLaMater v. Marion Civil Service Commission that the Commission was not exempted from disclosing the raw scores and grading scale for a police lieutenants examination under the state's Open Records Act. The Commission and the City of Marion argued that the scores were exempted from disclosure as trade secrets and because release would give repeat test-takers an advantage and violate the privacy rights of test-takers. The Court rejected all three arguments and found that whatever privacy rights are implicated are outweighed by public interest.

US West lease records must be disclosed

Article Abstract:

The Iowa Supreme Court ruled in US West Communications, Inc v. Office of Consumer Advocate that the state could require a telephone company to turn over lease records for a rate investigation. The court rejected company arguments for the application of the trade secret exemption and exemption for reports to the government with information devoid of public purpose but possibly useful to competitors. The court ruled the trade secret exemption applied only to records with economic value.

'Comp time' records for state employees must be disclosed

Article Abstract:

The Mississippi Supreme Court ruled in State Dept of Wildlife, Fisheries & Parks v. Mississippi Wildlife Enforcement Officers' Assn that records on 'comp time' for state employees are not a personnel record exemption under the state open records law and must be disclosed.
