Control issues

Article Abstract:

Broadcast stations must be careful to comply with FCC rules governing transfer and retention of control of operations, particularly in the areas of stations' finances, personnel, and programming. Local market agreements (LMAs) are not considered unauthorized transfers and licensees can delegate daily operations while working under LMAs. Guidelines for proper observance of FCC rules on control of personnel, finances, and programming are discussed; a 1996 FCC investigation is presented as example of a control inquiry.

Contingent applications

Article Abstract:

The Mass Media Bureau of the FCC may stop accepting stations' contingent applications for transfer of control or assignment because the number of applications has exceeded the resources available to work on them. Although the FCC has previously accepted contingently filed applications, the Bureau is empowered to stop this practice. If this policy change is implemented, pending applications will continue to be processed, although unfiled applications will not be handled.

Ownership rules

Article Abstract:

National and local TV station ownership rules are being reviewed by the FCC. For example, the rules governing same market radio and TV ownership could be completely redone. Proposals being considered cover areas such as common TV station ownership and the attribution rules. The potential effect on TV LMAs and Joint Sales Agreements, the equity or debt plus proposal, the satellite exemption, and the ADI and DMA national audience calculation methods are also discussed.
