Employment contracts - "blue line" rule

Article Abstract:

Non-competition clauses or covenants-not-to-compete in broadcasters' employment contracts may have to be blue lined to comply with court decisions on their enforceability. Blue lining is typically used by a judge to revise contractual language regarding reasonableness. For example, until a statute was enacted to address this issue, Florida judges would blue line covenants-not-to-compete so as to fix reasonable distance and duration restrictions, a situation which created havoc in negotiating such contracts. Careful drafting of these clauses can prevent subsequent blue line amendments.

Noncommercial stations - underwriting announcements

Article Abstract:

Noncommercial stations must handle program underwriters carefully. Generally, an on-air acknowledgment of consideration from an underwriter will be considered acceptable, if the announcement does not exceed certain parameters. While slogans that promote businesses cannot be used, properly worded acknowledgments of underwriters are acceptable. Price information, sales inducements, or calls to action cannot be used in announcements of underwriters.
