Infringement or impingement: carving out an actual knowledge defense for Sysops facing strict liability

Article Abstract:

A survey of system operators who operate bulletin board services accessible via the Internet and who may also offer Internet access was conducted to determine the feasibility of applying strict liability to online services. As computer networks, which offer online services, are the 21st century equivalent of a public forum, speech online is subject to the same speech restrictions on private property. However, findings show that strict liability cannot be appropriately implemented against online services. The passage of the Digital Millennium Copyright Act provides online services relative freedom to function as intended without having to track their content for infringing material.

Two individuals who were subjects of late author and journalist Tony Lukas' book 'Common Ground: A Turbulent Decade in the Lives of Three American Families' praise Lucas for his investigative abilities, compassion and obsession with accuracy. They also say that Lukas could get even the most reluctant subjects to open up about themselves because of the gentle way he asked questions and attention he paid to their answers.
