Redundancy on expiry of successive fixed-term teaching contracts

Article Abstract:

A 1996 UK Employment Appeal Tribunal ruling held a redundancy situation occurs when a part-time college teacher's contract expires at the end of the term, even if offered a new contract for the next academic year. In two separate cases, college lecturers who had been employed under several successive fixed-term contracts, were declared eligible for redundancy pay under this ruling. Such cases are not to be considered constructive dismissals; however, teachers are not entitled to make redundancy pay claims at the end of each term simply as a matter of course.
