McCormick, FTC in talks to settle spice price lawsuit

Article Abstract:

McCormick and Company Inc is in the process of negotiating a settlement with the US Federal Trade Commission (FTC) on allegations of price discrimination in an effort to avoid a costly legal battle. The agency was set to file a lawsuit against McCormick after finding out that it paid large fees that amounted to discounts to only some retailers. After reviewing 2,200 of McCormick's contracts for nearly three years, the FTC found three instances of violations of the Robinson-Patman Act.

FTC may sue McCormick over spice prices

Article Abstract:

McCormick and Co faces an antitrust lawsuit that would accuse the spice manufacturer of selectively giving discounts. Staff attorneys at the Federal Trade Commission have recommended filing a suit against the company, which they found to have been paying hefty fees to assure shelf space in some stores. The Robinson-Pactman ACt, a Depression-era legislation, prohibits manufacturers from imposing different prices to different retailers.
