Inside the proposal: Why a breakup?

Article Abstract:

The US Justice Department in the end favored breaking up Microsoft Corp because they were convinced the software giant would find ways to go around behavioral curbs designed to check its predatory tactics. Government prosecutors had considered strict curbs, but decided on splitting the company along product lines after settlement negotiations broke down in Apr 2000. Government prosecutors are calling for creating two new companies, one for the Windows operating system and the other for applications and Internet software.

Microsoft case to go before full U.S. Court of Appeals

Article Abstract:

The US Court of Appeals has decided to hear Microsoft's appeal of its antitrust case. The full court is regarded as a mostly conservative panel that could rule against Judge Thomas Penfield Jackson's decision to divide Microsoft into two companies. The Justice Dept has filed a request to send the case directly to the Supreme Court. Microsoft is against moving the case directly to the Supreme Court and instead wants it to be coursed through the Circuit Court and the Court of Appeals.
