Product liability

Article Abstract:

The doctrine of strict liability for unjustifiably dangerous and defective products led to the increase of lawsuits and of product liability insurance premiums. Business groups lobbied for reforms but met little success in the US Congress. However, they were able to influence state legislatures in imposing product liability legislations that eventually detered further increase of the insurance premiums. In the 1980s, judicial bodies tended to favor defendant manufacturers over plaintiffs. This shift of attitude contributed to the decrease in filing of lawsuits.

Should ideas be treated like autos?

Article Abstract:

The US takes the lead in technology research and development. However, GATT has no specific rules that would protect the rights on the mental reasoning that led to the conception of a product in the first place. Although most countries have patent rules and regulations, none are as rigid as the US. Laxity with patent regulations inevitably leads to patent theft and Asian countries proved to have the most rampant cases of such offense.

At issue: has there been a litigation explosion in the United States?

Article Abstract:

The sharp increase in the number of lawsuits filed in the United States is both criticized and defended by two opposing groups. Its critics suggest that the phenomenon is caused by opportunistic individuals who use lawsuits as an opportunity for personal gain. On the other hand, its supporters argue that court cases actually help society because litigations encourage institutions toimprove their products and services.
