After a two-year battle, George W. Bush's conservative nominee to the United States Court of Appeals for the District of Columbia, Miguel Estrada, has requested that his name be withdrawn from nomination. Republicans roundly condemned Democratic Senators for their filibuster and threat of extended debate that kept the nomination from coming to a vote, citing the nominee's high qualifications. Democrats responded that the White House has refused to provide the Senate Judiciary Committee with memos written by Mr. Estrada during his time as assistant solicitor general in the Justice Department, which might have shed light on the views held by what they term a 'stealth nominee.'

A Senate filibuster led to the rejection of judicial nominees Janice Rogers Brown, Carolyn B. Kuhl and Priscilla R. Owen. The Democrat-led filibuster underscored the political battle over judges whom the Democrats believed represented unacceptable philosophical positions for judicial service. It was also suspected that Pres. Bush presented unacceptable women judges so that he could accuse Democrats of refusing to appoint women to federal benches. Republicans emphasized that Democratic legislators were simply rejecting any recommendations from the president and refusing to select qualified judges simply because they were Republicans.
