A challenge for the World Trade Organization: towards a true transnational law

Article Abstract:

Transnational law applied to economic transactions should not be distinct from international and national legal systems and, through the World Trade Organization, would be the appropriate venue for regulating cyberspace and similar novel phenomena. Past efforts to design a law for international trade, along the lines of the lex mercatoria, have failed because they tried to avoid the necessary involvement with national-level legislation. Modern global organization demands a comprehensive, competent transnational law.

Contextual imperatives of dispute resolution mechanisms; some hypotheses and their applications in the Uruguay Round and NAFTA

Article Abstract:

Reference to the dispute resolution mechanisms (DRMs) of the North American Free Trade Agreement and the World Trade Organization illustrates the complexity and potential choices in crafting such DRMs. NAFTA's DRM is appropriate for its intended uses, though feeble regarding subsidies and in the related Labor and Environmental agreements. The WTO's DRM is less promising on the whole, but relatively robust concerning subsidies. Other DRM theories, paradigms and approaches are also explored.

Tariff issues in the Uruguay Round; features and remaining issues

Article Abstract:

The Uruguay Round of negotiations for the General Agreement on Tariffs and Trade accomplished significant tariff reductions and bindings of lines, with worldwide economic impact. Tariffs have not been eliminated but were greatly reduced through talks of much greater complexity and difficulty than originally anticipated. The process has made tariffs a stronger trade policy instrument, and has increased market access while improving predictability and transparency in trade.
