A unanimous jury is fundamental to our democracy

Article Abstract:

Piecemeal, reactive changes such as eliminating the requirement for unanimity of jury verdicts would have unpredictable effects on the jury as an important democratic institution. The unanimous verdict brings a certain moral authority to the jury's decisions that might be eroded. In addition, minority viewpoints could simply be outvoted in a system that does not require unanimity, whereas in the current system they must be changed by persuasion. Legislatures should take a more comprehensive approach to reform, one that would preserve the basic institutional features of the jury while correcting some of its obvious defects.

The decline of WASP reserve

Article Abstract:

Social status in US society is no longer limited to the closed-ranks of White Anglo Saxon Protestant (WASP) communities. The qualities of WASP society - tradition, thrift, understatement - are not the indicators that status achievers use to establish their social worth. Gentility and authenticity are replaced with a social-conscienceness that depends upon establishing respect for the trend of the moment.
