China and the United States: "rules of origin" and trade statistics discrepancies

Article Abstract:

US-compiled statistics on import and export trade with China are misleading, due in part to the US's use of such statistics as a revenue generator rather than an accurate reflection of trade. The US attributes the origin of many goods from Taiwan and Hong Kong to China, though they are really Taiwanese or Hong Kong imports. This has created the impression in the US that jobs are being lost to China, which could result in uncalled for protectionism on the part of the US. In reality, the growth in Chinese imports is a result of more and more goods that for years have been produced in other places, such as Hong Kong, now being attributed to China.

Court of International Trade judges, binational panelists, and judicial review of U.S. antidumping and countervailing duty policies

Article Abstract:

A study on the judicial evaluation of US' antidumping (AD) and countervailing (CVD) policies is developed to determine trends in the decision-making processes of the Court of International Trade (CIT). 557 of AD and CVD cases appealed to the CIT and 16 cases of appeal to the Binational Panel is used in the study. Results show that the Panel has been able to correct mistakes by veering away from the judicial methods used by the CIT.
