Constructing justices for existing practice: Rawls and the status quo

Article Abstract:

John Rawls assumes that all reasoning that social justice requires begins from existing practices. The idea that existing practices constrain what fundamental principles apply has an attractive rationale in the idea that principles of justice are moral constraints instead of ideal goals.

Rights and the doctrine of doing and allowing

Article Abstract:

The doctrine of doing and allowing (DDA) indicates that doing harm is more difficult to justify than allowing harm. Some attempts to align DDA with moral common sense fail in virtue of obstacles that can be overcome by adopting a rights-based analysis.

The nature of rights

Article Abstract:

A modified Hohfeldian framework that elaborates the meanings of assertions of rights is presented. The main aim is to reveal what kinds of things rights are, and the significance that rights have for those who hold them.
