Fair price comparison in the WTO anti-dumping agreement

Article Abstract:

The World Trade Organization Anti-dumping Agreement that resulted from the Uruguay Round of Multilateral Trade Negotiations strengthened the "fair price comparison" requirement in the World Trade Organization Anti-dumping Agreement (also know as The Agreement on Implementation of Article VI of the General Agreement on Tariffs and Trade 1994, Final Act Embodying the Results of the Uruguay Round of Multilateral Trade Negotiations). The strengthening of this requirement is evident in several recent decisions, especially "European Communities--Anti-dumping Duties on Imports of Cotton-type Bed Line From India, United States--Imposition of Anti-dumping Duties on Imports of Fresh and Chilled Atlantic Salmon from Norway EC--Anti-dumping Duties on Audio Tapes in Cassettes Originating in Japan, EC--Imposition of Anti-Dumping Duties on Imports of Cotton Yarn from Brazil," and "United States--Anti-dumping Measures on Stainless Steel plate in Coils and Stainless Steel Sheet and Strip form Korea."

Public international law and third party participation in WTO panel proceedings

Article Abstract:

The Dispute Settlement Understanding provision of the World Trade Organization (WTO) allows a third party to intervene in the settlement of a dispute. The third party is allowed to attend Panel meetings and directly participate in the proceedings. However, the International Court of Justice (ICJ) only allows third parties to participate under certain conditions. Third party interventions in the ICJ are quite rare and has only been done once in 1990. The procedural rights of third party participants in both WTO and ICJ cases have yet to evolve alongside the WTO dispute settlement system into a truly judicial-based system.

Developing country practice in the matter of WTO dispute settlement

Research is presented concerning the single, integrated system for multilateral trade agreement dispute settlement which resulted from the Uruguay Round and the emergence of the World Trade Organization.
