International trade law and international environmental law: prevention and settlement of international environmental disputes in GATT

Article Abstract:

The growing concern over environmental degradation is causing the evaluation of mechanisms of an international nature for dealing with problems such as transboundary pollution and hostile commercial policy based on environmental concerns. The GATT and United Nations Conference on Environment and Development appear to be ideal venues for reaching consensus on addressing environmental issues which impact international trade. Five GATT settlements from between 1982 and 1992 are examined for their effects on the evolution of these policies.

Thirty years of being a respondent in antidumping proceedings; abuse of economic relief can have a negative impact on competition policy

Article Abstract:

Antidumping investigations, initiated to protect threatened industries, are costly proceedings which often fail to resolve the issues at hand. The World Trade Organization should work towards repealing Article VI of the Antidumping Code and more constructively utilizing its resources to promote collaboration.
