Where the action is: on the site of distributive justice

Article Abstract:

A study proved that personal choices to which the law is indifferent are fateful for social justice. It also suggested that the Rawlsian theory, which underlies that principles of justice govern only the basic structure of a just society, is unsustainable. Moreover, Rawl's argument that citizens in a just society may adhere to the difference principle is inconsistent with many of his contentions about the relationship between citizens and principles of distributive justice in a just society.
