A question of consent

Article Abstract:

Several cases dealing with agreements to assignment in landlord and tenant leases have been heard in the UK courts. A 1997 case found landlords were permitted to ask for full information of a possible assignee when permission to assignment has been requested. In a second case the landlord sought to prevent a tenant subletting commercial premises at a lower rent. The courts agreed the landlord was wrong to have not given consent as the lower rent was not less than market value. But if the landlord had believed the rent to be less than market value it was correct for the landlord to refuse consent.

Business tenancies: 1994 update

Article Abstract:

A smaller number of cases were reported in 1994 under the operation of the United Kingdom Landlord and Tenant Act 1954 Part II after hearings were transferred to the county court from the High Court. A summary of some of the cases heard in 1994 is presented, with the cases including M&P Enterprises (London) Ltd v Norfolk Square Hotels Ltd, Nicholls v Kinsey, Graysim Holdings Ltd v P&O Property Holdings Ltd, Rumbelows Ltd v Tameside Metropolitan Borough Council, Busby v Co-operative Insurance Society Ltd and Turner v Wandsworth London Borough Council.

Rent review: 1994 update

Article Abstract:

There were a number of important legal cases dealing with rent reviews in 1994, many of which have gone to arbitration. Among them are Co-operative Wholesale Society Ltd. v National Westminster Bank, Scottish Amicable Life Assurance Society v Middleton Potts & Co. and Amego Litho Ltd. v Scanway Ltd. A summary of the most important cases is presented.
