Adverse possession

Article Abstract:

A UK legal case involving adverse possession resulted in the dismissal of an appeal by a landlord. The appeal was made after the death of the husband of the defendant who had an oral tenancy on a house used as a second home. Rent was not paid from 1971, since it was not clear who should receive the rent. The tenant was entitled to stay in possession of the property and to pay rent during the period from 1971 to 1995 when the case was decided. The landlord was also entitled to demand rent arrears.

Daejan Properties Ltd v Mahoney

Article Abstract:

A UK legal case involving a landlord and tenant concerned the daughter of a statutory tenant. The original statutory tenant died, leaving the daughter and her mother as joint tenants. The mother died and the daughter claimed to be a statutory tenant. The landlords argued that the daughter was an assured tenant, and their case was initially upheld in a county court. An appeal court allowed an appeal by the daughter, that she was a statutory tenant.

Landlord and tenant: specific performance

Article Abstract:

A UK legal case involving landlord and tenant related to a breach of a convenant to repair of local government public housing. Two tenants complained of lack of repairs to their homes and a small claims arbitrator ordered specific performance. This was taken to appeal by the council, Liverpool City, and both a county court and the Court of Appeal dismissed the appeal, arguing that the small claims court was entitled to make this decision.
