Restrictive covenants and restraint of trade

Article Abstract:

UK cases on employment contracts' restrictive covenants during 1995 included decisions on confidentiality, trade secret protection, courts' authority to sever contract provisions unlawfully restraining trade, and prohibitions on poaching employees. Restraints generally prohibited by statute can be legal if they are reasonable and needed to protect legitimate business interests. The effects of a clause, rather than its form, is the basis for interpreting it as a restraint of trade.

Agriculture: milk quotas

Article Abstract:

A UK legal case involved milk quotas for dairy farmers. The applicant producers of milk were initially granted quotas which were later withdrawn by the UK Ministry of Agriculture, Fisheries and Food. The applicants sought compensation and the High Court ruled that the ministry's decision was lawful, since it had the authority to withdraw quotas, and the applicants did not fulfil conditions needed to be granted quotas. Their application for a judicial review was not allowed.

Hush of suicide

Article Abstract:

Families of suicide victims often lament the fact that they were unable to prevent their kin from doing so. This feeling of guilt reflects a general public attitude towards suicide.
