Casting light on a grey area

Article Abstract:

The UK planning laws can restrict the size of a building if the development prevents other buildings retaining their light. A case heard in the courts found the planning laws could also be used to protect the views of residents living nearby a proposed new development. The common law gives the tenants or owners of the dominant tenement the right to light and allows them to go to court to protect their rights. Being granted planning permission does not mean the developer cannot be challenged under the common law of right to light.

Article Abstract:

Issues are presented concerning the implications for town planners of the flooding experienced by communities whose businesses and properties were flooded in 2000. Global warming, flood defences and building on flood plains are discussed.
