Article Abstract:

Planning authorities, in the UK, have the right to decide if a planning permission should have certain conditions. A number of cases heard in the UK courts demonstrated the authorities rights to impose conditions over land which is not included in the permission. The courts decided a condition was fair and appropriate even though the landowner did not have control over the land where the condition was imposed. A local authority had stated the road outside a new development should not be used to park vehicles belonging to the development in order to avoid obstructing the road.

Area management: The White Paper on regional development agencies clarifies their composition and remit, and states that they will not determine planning policy - but their effect could still be powerful

Article Abstract:

The government's White Paper Building Partnerships for Prosperity sets out detailed proposals for setting up regional development agencies (RDAs). The setting up of the RDAs is part of government plans to decentralize decision-making. An RDA in each region will be established to promote sustainable economic development, and regeneration and will enhance skills and provide business support investment and competitiveness.

Use of enforcement procedures

Article Abstract:

Research has revealed that around 5,000 planning contravention notices are served annually. The statistics have been published in the 'Evaluation of Planning Enforcement Provisions' report by the DOE. Such notices are served by the local planning authorities in cases where there may have been a breach of planning control. An overview of the DOE statistics and the use of such notices is given.
