Environmental outlook clouded

Article Abstract:

Two recent cases, involving Envirocor Waste Holdings v Secretary of State for the Environment and R v Berkshire County Council, ex parte Wokingham District Council, have highlighted the continuing importance of environmental issues in planning decisions. This goes against the views of some observers who have been claiming recently that the property industry has entered a phase of 'environmental fatigue.' New legislation set out in the Environment Bill will also be of key sigificance for the property industry, greatly increasing the potential for negligence claims.

Kept in the dark

Article Abstract:

Pre-planning application talks with local councils may be to the advantage of property developers but they should be aware that any information may be given on an informal basis. A legal judgement found that a local council representatives had given false information, which they knew to be incorrect, to a developer. The council was made to pay several million pounds sterling to compensate the developer. A second case found that informal information given by a representative of the planning authority is not to be taken as the official view of that authority.

Retail uses - all change, please?

Article Abstract:

UK planning law relating to changes of use which have not been approved often involve difficulties in assessing what the appropriate planning unit is comprised of. This may be the case where there is a retail development with individual shops and other units. The issue was important in a case involving change of use for a single unit at the MetroCentre, a retail development in Gateshead, England. In this case the single unit was seen as the appropriate planning unit.
