Unforeseen dangers

A case in the United Kingdom Court of Appeal in June 2001 could have serious consequences for local planning authorities. The case concerned liability relating to requirements imposed by planners and may increase cases of negligence for planners.

Is it a bird, is it a plane, is it a material change of use?

Article Abstract:

The Appeal Courts in the United Kingdom decided that Thames Heliport had made a material change of use by using a heliport constructed on a vessel floating on the River Thames, London. Thames Heliport had been refused permission to build an inland site to land helicopters. The company chose to use a flat decked vessel as a heliport, which would only be moored at night when it was not in use. The courts judged that the use of the riverbank as a mooring materially changed its use. The effect of noise and visual damage to the surrounding area were also considered by the courts.
