It's a dirty business

Article Abstract:

The UK Environment Act 1999 will have implications for land managing agents who may been taken to court if they fail to inform property owners of any pollution on the site. Some insurers have already realised the difficulties the act may cause landowners and managing agents and have introduced the Environmental Impairment Liability insurance to cover the cost of cleaning up a site. The Environment Act permits local authorities to find and charge clean up costs on companies which have polluted land or the property owners. Land which is not cleaned will be placed on the Contaminated Land Register.

Cautionary tales

Article Abstract:

The legal use of caution has different meanings depending on the circumstances in which it is used. In land registration a caution may be used to warn possible buyers that there are third-party rights in the property. A formal caution may be used by the police in some cases instead of a prosecution. The caution is registered and a further offence will make criminal prosecution far more likely. A caution is given to suspects during an inquiry into a crime. It serves to remind them that they do not have to say anything.

Owners wield the bucket

Article Abstract:

UK landowners face possible expensive clean-up costs if their land is found to be contaminated and the original perpetrator of the contamination can not be located. Insurance firms provide a range of policies to protect land owners from such expensive actions, although it is advisable to seek professional advice before choosing a policy as the clauses governing payment will be very strict.
