Lead paint and "sick building syndrome" liability claims

Article Abstract:

An increasing number of families are filing liability suits against their building owners for illness from sick building syndrome, which causes health damages due to exposure to hazardous fumes and pollutants. Building owners can avoid paying huge liability claims by buying insurance policies that will protect them against such claims in the future. These policies should provide insurance coverage for property personal injuries and property damages. Owners must also notify their insurance agents or brokers about claims against them and seek coverage for these claims.

Important points about lead paint removal

Article Abstract:

Building owners who are planning to eliminate conditions which can contribute to lead poisoning in their property can purchase insurance policies that provide coverage for the costs of lead removal. However, there are policies which deny coverage for these claims under the 'pollution exclusion' clause. The policies which building owners should consider are the Building Ordinance Policy Rider, which provide coverage for loss or damages caused by enforcement of a law, and Owner's Liability, Comprehensive General Liability, Umbrella and Excess Liability Policies.

Insurance coverage disputes in carbon monoxide claims

Article Abstract:

Insurance service providers are liable to shoulder the cost of environmental damages resulting from carbon monoxide misuse, as provided by the comprehensive general liability policies of the federal government. Although insurance companies are entitled not to cover several pollution claims, building owners and managers are authorized to seek liability claims for carbon monoxide damages, whether or not they are caused by faulty furnaces.
