Negligence - a field day for lenders and borrowers?

Article Abstract:

Most discussion of six recent Court of Appeal decisions involving negligence, including the Banque Bruxelles Lambert vs Eagle Star Co case, has focused on the implications of the rulings for valuers and their insurers. However, it is also worthwhile looking at the ways in which these decisions can be exploited by lenders and borrowers. It appears that it is in the interests of borth the lender and the borrower to establish 'no transaction' lending or borrowing, stating that the deal would not have gone ahead but for the valuation.
