Overdue reforms

Article Abstract:

The recommendations contained in Sir Michael Latham's 1994 report 'Constructing the Team' with regard to construction contracts have now been implemented by the UK government. The legislation contains a wide definition of construction contracts, and its definition of construction operations embraces maintenance, demolition, repair and construction. It prohibits the withholding of a payment which is due unless notice of intention to withhold is given before the final date for payment. It also entitles anyone who is not paid money due to suspend work on seven days' notice.

Contractors' losses and expenses

Article Abstract:

Construction contractors can claim for losses and expenses as a less cumbersome way of obtaining compensation than a damages case. The terms loss and expense are included in many building contracts and claims tend to refer to situations where contractors are hindered by employers from carrying out work. Delays may be of several types and the main reason for delay has to be assessed. Delays may also slow down work rather than halt it, and in this case contractors suffer from lower productivity.
