Private-sector lettings

Article Abstract:

The Housing Act for private landlords and tenants incorporates provision applying only to houses and flats let as dwellings. The provisions deal with service charges in which section 81 prevents the landlord from exercising the right of re-entry or forfeiture for failure to pay a service. Also section 83 alters the rules for challenging services charges. Section 96 makes provision for assured tenancies and there are amendments to previous Acts relating to the acquisition of the freehold of blocks of flats.

Drafting farm business leases

Article Abstract:

Qualified surveyors are now permitted under the Agricultural Tenancies Act 1995 to draft farm business leases for more than three years. Surveyors wishing to undertake this work should first ensure that they have all the relevant legal knowledge. It is important to be aware that circumstances can alter during the lifetime of an agricultural lease, and to take into account factors such as the use of the property, buildings and cropping.

Taking notice

Article Abstract:

Lease renewal involves a number of procedural and legislative requirements, and it is therefore vital that work on lease renewal begins a long time in advance of the date of expiry. It is necessary to allow time for both the landlord and tenant to consider future options. Tenants must ensure that the lease is broken on the correct day, and should seek break facilities that are conditional only on the payment of outstanding amounts.
