Renewals under Woolf

Article Abstract:

It is likely changes to the procedures for lease renewals, under the UK Landlord and Tenant Act 1954, will result in increased intervention by the Professional Arbitration on Court Terms scheme. Many aspects of lease renewals will not be changed but cases will not be permitted to remain in negotiation for a long period of time. If they cannot be agreed within 28 days they will be managed by the court. The role of expert evidence will be more limited and the party serving the statement must ensure it has been verified.

Justice on a faster track

Article Abstract:

Reforms to English civil court procedure due to come into operation on Apr 26, 1999, will affect property cases in a number of ways. Summary judgment will be expanded in two valuable ways, but it will not be possible to obtain summary judgment in possession proceedings of residential premises against a tenant or former tenant. Where a residential tenant puts in a defence, the facts of which he or she is willing to verify as true and which disclose a defence in law, the landlord will be forced to undergo a trial.

Recovery of services charges

Article Abstract:

In September 1996, sections 81 and 82 of the Housing Act, 1996, came into force. The object of these sections is to outlaw unscrupulous landlords who have threatened leaseholders when service charges have either been disputed or not paid. In the past freeholders have been able to forfeit a lease when a tenant has disputed the service charge. It will also be more difficult for freeholders to collect legitimate charges.
