Article Abstract:

The UK Law Society has issued a version of the Standard Conditions of Sale (SCS) standard contract form for commercial property transactions. The Standard Commercial Property Conditions (SCPC) is the same as the SCS in many respects, but important differences include provisions for the buyer to accept risk after exchange and simpler approaches to leases and late completion compensation. The SCPC form is more appropriate to commercial property dealings but it is still not applicable in all circumstances and special conditions will continue to be necessary.

Development in conservation areas - the challenges

Article Abstract:

PPG 15 - Planning and the Historic Environment was issued in September 1994 offering advice and guidance on development near or in a conservation area. There are currently over 8,000 conservation areas in the UK, these include 'areas of special architectural or historic interest the character or appearance of which it is desirable to preserve or enhance'. The practical obstacles faced by developers proposing development near such areas is discussed.

Hindcastle revisted. (issues of disclaimer in commercial leases arising from the Hindcastle judgement)

Article Abstract:

The unanimous judgement of the House of Lords in Hindcastle Ltd v Barbara Attenborough Associates Ltd case is seen as a landmark decision, and of benefit to landlords. It relates to the issues of disclaimer in commercial leases and prior cases made the matter more complex for landlords. The Hindcastle case related to an old tenancy for the purposes of the 1995 Act which does not amend basic provisions governing disclaimer of leases.
