Title insurance: the exclusion for creditors' rights after 1992

Article Abstract:

The American Land Title Assn changed language in its title insurance policy forms for 1992 narrowing the scope of a 1990 amendment that excluded coverage that conflicted with creditor protection laws. The changes embody policies that title insurers have operated under for years, denying coverage for losses arising from fraudulent conveyances or as a result of federal bankruptcy law. This policy change makes certain types of transactions such as leveraged buyouts and upstream guarantees more difficult because of conflict with those laws. Issues in current case law are also presented.

The regulation of medical waste: the 1990 California Medical Waste Management Act

Article Abstract:

California's Medical Waste Management Act of 1990 (CMWMA) shares features of the EPA's Guide for Infectious Waste Management and the Medical Waste Tracking Act, yet is also tailored to the health care industry's practices and operations. The CMWMA has comparatively more extensive registration, transportation, treatment and disposal requirements, as it applies to a greater number of medical providers and facilities, or medical waste generators. The CMWMA is comparatively less stringent in its recommendation of direct disposal as a preferred treatment method for some wastes.

Tenants' free expression rights on California rental properties

The authors discuss California's law regarding rental property, landlords' obligation to eliminate nuisances on their property, and tenants' freedom of speech rights when their expression is deemed to cause a nuisance.
