Is it time to revise the European regulation on public access to documents?

Article Abstract:

The Regulation 1049/2001 concerning access to documents needs to be modified since the way the Court of First Instance and the Commission construe the regulation is in contrast to the intended changes relating to transparency in the EU Constitution and the relevant political consensus. Even as there is stagnation in the ratification process, it is suggested that the Commission has enough reason to start a public debate on the timing of the revision of the Regulation 1049/2001.

Structure, objectives, and results of the Austrian Constitution convention: Or: How not to change a constitution

Article Abstract:

The structure, organization and objectives of the Austrian Convention initiated in 2003 with an aim to modernize the Austrian federal constitution so as to enable restructuring of the Austrian administrative system, are discussed. It was concluded that the existing 1920 Constitution has relevance even in 2006, and thus the discussions on the Austrian Convention resulted in not changing, but retaining and following the principles of the existing Federal Constitution.

Checks and balances in the European Union: The Institutional structure and the 'Community method'

Article Abstract:

The European Community (EC) legal system has provided comprehensive set of legal checks on EC power, and on the powers of each Institution and also provided political checks and balances, based on the role of the Commission as a policy-proposing body, representative of the EC as a whole and equally independent of all the Member States. This system, known as 'the Community method', is weakened by several factors and needs to be restored.
