From the battlefield to the courtroom

Article Abstract:

There are currently a number of legal actions involving the armed forces, and this trend is increasing as solicitors actively seek cases in this field. The recent case of Gunner Richard Mulcahy is the first in which one soldier has attempted to sue another for negligence. Soldiers are becoming much more aware of their legal rights, and some observers fear that this could seriously damage teamwork and morale. There could be wide-reaching implications if it is found that a soldier can be made liable for negligence towards a fellow soldier.

Slow justice is no kind of justice

Article Abstract:

The European Court of Justice (ECJ) has come under increasing pressure as a result of rising costs and a growing volume of cases. There are now plans to make significant changes to the way the ECJ operates, including setting up mini-ECJs in each European Union member state. A fast-track system for hearing cases and the introduction of case-filtering procedures will bring immediate improvements, but more dramatic changes are likely to attract political controversy.
