Companies rush to patent DNA

Article Abstract:

Although the US Supreme Court has ruled that entire genes can be patented, it is unclear whether individuals or companies can lay claim to 'expressed gene sequences,' DNA fragments that can be used to reconstruct complete gene sequences. Patent decisions are likely to influence the rate of discovery.

Suit alleges misuse of peer review

Cistron Biotechnology claims that Immunex Corp patents on interleukin-1 were aided by unauthorized information obtained during a peer review of Cistron scientist Philip Auron's submission to Nature. The case could be a landmark concerning the concept of confidentiality in the peer review process.

Cistron Biotechnology charges that Immunex Corp used in its own research and patent applications unpublished research Cistron had provided for peer review. A US District court will decide whether confidential peer review is a legally valid practice.
