Discrimination in workplace dynamics: toward a structural account of disparate treatment theory

Article Abstract:

Discrimination in the workplace has become more subtle as a result of changes in the way workplaces are structured. Discrimination is taking place largely within the concept of workplace dynamics and is difficult to trace to certain incidents or people. A new interpretation of Title VII of the Civil Rights Act of 1964 is needed which takes these facts into account and requires employers to remedy this type of discrimination.

Statutory speech bubbles, First Amendment overbreadth, and improper legislative purpose

Article Abstract:

In Hill v. Colorado, the US Supreme Court affirmed a Colorado law that restricted protests within 100 feet of any health care facility. Thought the law was aimed at abortion protesters, the Court believed it was constitutional because of its broad language. The constitutional overbreath doctrine should, however, be interpreted in such a way that it will not allow this sort of disguised viewpoint discrimination.

Queers anonymous: lesbians, gay men, free speech, and cyberspace

Article Abstract:

Attempts to regulate speech on the Internet especially effect gays and lesbians. The anymous feature of e-mail is especially important to these groups. Any attempt to limit their Internet speech should be subject to intense judicial review.
