Federal habeas corpus in a nutshell

Article Abstract:

The importance of the writ of habeas corpus in death penalty litigation is discussed. This writ gives the lower federal courts the power to examine capital sentences imposed for state criminal offenses. Restriction of the writ by the Antiterrorism and Effective Death Penalty Act of 1996 is also discussed.

The Supreme Court's narrow majority to narrow the death penalty

Article Abstract:

The Supreme Court's death penalty litigation is discussed, including the pending ruling in McCarver v. North Carolina, when the court may rule against capital punishment for the mentally retarded. The choice between the death sentence and life without parole is also discussed.

Mentally ill defendants: systemic bias in capital cases

Article Abstract:

Use of the insanity defense trials for violent crimes committed by mentally ill defendants is discussed. The use of forensic experts and the danger of using untrained experts to make medico-legal determinations is also discussed.
