Religious equality and the First Amendment

Article Abstract:

Two religious equality constitutional amendments proposed by Congress were critiqued by an ABA Section of Individual Rights & Responsibilities panel as threatening the separation of church and state. Rep. Ernest Istook's proposal was assailed for allowing government to prefer one religion over another. Sen. Orrin Hatch's proposal would allow government funding of religious schools and social services. Both attempt to treat religious and secular organizations equally, but the Establishment Clause requires religious organizations to be treated differently to avoid entanglement.

Responding to the crisis in death penalty representation

Article Abstract:

The ABA Death Penalty Representation Project reports that over 1,000 death row inmates do not have counsel working for post-conviction relief because of cuts to Death Penalty Resource Center financing and a dearth of attorneys willing to take such cases pro bono. There is no right to counsel after direct appeal, so volunteer work is essential to protecting the rights of convicts in capital cases. Congress is acting to change habeas corpus law to further reduce procedural safeguards and narrow federal review of state capital convictions.

Fitting religion into the nation's cultural landscape

Article Abstract:

Americans are a nation of plurality holding a variety of religious beliefs, and it is no longer appropriate to label Christian phenomena as part of the American heritage. The diversity in Americans' cultural heritage must be taken into account when deciding free exercise claims. Protecting a religious life characterized by religious freedom without government involvement is one of the best ways to uphold traditional values.
