Doctrinal synergies and liberal dilemmas: the case of the yellow-dog contract

Article Abstract:

A historical review of labor law jurisprudence reveals that as the US Supreme Court's favor of the liberty of contract waned, its protection of the employee's freedom of association rights, including the right to join a union, increased. In the New Deal era, the Court used the liberty of contract to uphold a number of what would in the 1990s be considered unconscionable work contracts, including yellow dog contracts prohibiting employees from joining unions for the term of employment. As the liberty of contract was abandoned as a bar to protectionist labor laws, Congress' powers to regulate commerce and the right to freely associate took its place.

It is vital that the political nature of allegations that a Taiwanese-born scientist at the Los Alamos National Laboratory leaked US nuclear secrets to China is not allowed to cast a shadow over the significant role played by Chinese-American scientists in the US. In fact, US science owes a great debt to Chinese-American scientists, and the American Physical Society and other scientific societies should therefore ensure that pressure is put on national leaders to support Chinese-Americans' role in science and society.
