The United States Trustees: a look backward and a look forward
Article Abstract:
The Bankruptcy Reform Act of 1978 was enacted by Congress to improve the bankruptcy process by removing the administering of bankruptcy cases from bankruptcy judges, such that they would only act when a significant legal dispute came up between parties in a case. Instead, the United States Trustees were appointed to take over the administrative duties and to watch over bankruptcy cases to prevent dishonesty, fraud, and overreaching in the system. The Trustees began work in October 1979 and by the end of that year, over 15,000 bankruptcy cases had been filed. Ways in which the Trustees handle Chapter 7, 11, and 13 cases are examined. The Trustees pilot program will end on September 30, 1986, and Congress must decide whether to end, continue, or expand the program. If it is abandoned, the courts will take on several hundred thousand cases.
