Tobacco companies have been found guilty of not telling the truth about the addictiveness and dangers of tobacco, by a court in Dade County, Florida, and punitive and compensatory damages are to be awarded. The fine may later be reduced, but the companies may have to post a bond for damages, which could lead to bankruptcy for some companies. This could lead to legal battles over conflicting state jurisdictions. Meanwhile, the industry has succeded in striking down a bid by the Food and Drug Administration for regulation of the industry.

When lawyers inhale

Article Abstract:

The US tobacco settlement of 1998 has effectively meant the introduction of bad taxes designed by lawyers who gain part of the proceeds. An initial agreement failed because it was not supported by Congress. It was replaced by a new agreement for which the approval of Congress was not needed. The agreement has little impact on the profits of tobacco companies, does little to reduce levels of smoking, and involves higher taxes for smokers, who tend not to respond to price rises with reductions in demand.
