Article Abstract:
Management contracting, in the UK construction industry, was popular in the 1980s but several major projects ended in court. The aim of using management contracting was to cut confrontation between designer, contractor and client. It also reduced time spent on construction, as work was started before the designs were finished. A contractor would be appointed in two phases, the design phase and the construction phase. Management contracting could work if the contractor was employed to give advice during the design stage and as a lump-sum contractor for the construction stage.

Issues are presented concerning the 33% fall in the number of cases coming before the Technology and Construction Court in the year to July 2000. The resolution of disputes by negotiation rather than litigation is discussed.
